Rule 95
Exceptional family instincts and gifts

(1) In the event of an employee's immediate death due to an accident in the course of government work, or in the event of his/her death after not recovering from the same, his/her wife or husband shall be entitled to an amount equal to fifty percent of the minimum pension as per sub-section (2) of section 48 of the Act and an additional gratuity to his/her wife or husband separately as monthly family pension. The amount of three months' salary received by the deceased employee will be given as a lump sum.
(2) The widowed wife of an employee will be recognized only in the following cases:-
(a) Before the incident of death due to the above-mentioned causes, there should be a marriage relationship with such employee.
(b) At the time of the employee's death, he should have been living with him.
(3) If there is no widowed wife or if she has separated from her husband before his death, or if such a widowed wife is born before her remarriage, the child or adopted son of the deceased employee may be given a lump-sum payment by Damasahi as specified in sub-rule (1). However, if there are children or adopted children under the age of eighteen years, the government of Nepal can give them additional family allowance until they reach the age of eighteen years, at a rate determined by the government as reasonable, so that it does not exceed two-thirds of the amount of family allowance received by a widowed wife.
(4) If there is no widow, widower, child or adopted son of the deceased employee, and if the employee's dependent parents are both or one of them, for the sake of their livelihood, family allowance may be given for life not exceeding two-thirds of the amount of family allowance received by the widow.
(5) If there is any dispute regarding the widow, widower or descendants of the deceased employee, the Government of Nepal can take action in a reasonable and just manner.
(6) If there is no widow, child, adopted son or mother and father of the deceased employee and if such employee has dependent brothers, brothers or unmarried sisters or any of them, for the purpose of their livelihood, the damasahi shall not exceed two-thirds of the part of the family inheritance received by the widow for the period deemed reasonable by the Government of Nepal. It can provide family benefits at reasonable rates.
